Agreement concerning matters of custody, residence, and contact
In the event of a divorce or separation involving children in common, parents must decide whether custody will be joint or sole, whether the child will alternate living with both parents, or if the child will reside with one parent and have visitation with the other.
These decisions must be made during what is often a very turbulent time in life, and it is not always possible for parents to reach an agreement on their own regarding matters concerning the child.
If an Agreement Cannot Be Reached
When parents cannot agree, they can seek assistance from the Family Law Office in their municipality to facilitate communication and work towards a mutual agreement. The Family Law Office provides free support in the form of cooperation discussions, which can be a helpful way for parents to establish a new way of co-parenting after their relationship has ended, while their role as parents continues.
The Family Law Office can also assist in drafting legally enforceable agreements between the parents. Once approved by the municipality’s social welfare committee, these agreements are as binding as a court judgment.
If a Custody Dispute Arises
In some cases, parents are unable to reach an agreement through the Family Law Office, or one parent may refuse to cooperate. In such situations, it is crucial to seek legal assistance immediately. At Advokatfirman Glimstedt, we have extensive experience in guiding parents through custody and visitation disputes. Seeking help from a law firm does not necessarily mean the dispute must be resolved in court.
When possible, our aim is to assist the parent we represent in working with the other parent to develop a solution that serves the best interests of the child. If reaching an agreement proves impossible, we provide full support throughout the court process. This includes offering advice and guidance in dealings with authorities and managing all communications with the other parent or their legal representative.
At every step of the process, we carefully review what will happen next with our client, providing advice at each stage to ensure they feel secure and fully prepared.
Consider the best interests of the child
For children of separated parents, it is essential to have clarity about their living arrangements—when they will stay with their father, when they will stay with their mother, and who they will spend holidays with. When parents cannot agree, there is a risk that their relationship will deteriorate further, making it even harder to reach a solution that benefits the child.
We are committed to helping parents navigate these challenging situations while keeping the child’s best interests at the forefront.
