What happens if cohabitants separate?
Cohabitation property refers to the shared home and household goods, if the property was acquired for joint use. Other property that you own yourself is not included in the division of property. This could be a car or a holiday home, for example.
When a cohabitation relationship ends, the cohabitation property is generally divided between the parties if one of them so requests. The division of property between cohabitants can be requested within one year of the end of the relationship.
You can decide how your property will be divided if your cohabitation ends. This is done by means of a cohabitation agreement in which it can be agreed whether the rules of the Cohabitation Act on division of property apply.
Do cohabitants inherit from each other?
It is important to note that cohabitants do not inherit from each other by law. In the event of one partner’s death, their assets will go first to the deceased’s direct heirs and then to the other legal heirs.
This can often cause problems for the surviving partner if the partners owned the joint property together. If you want to change the legal order, you can do so by drafting a will stating, for example, that the surviving partner will inherit the deceased’s share of the property.
