Why is a deed of gift useful?<\/h2>\n

In some cases, for example when the gift is property, a written deed of gift is required. However, it can often be useful to draw up a deed of gift whether it is required or not.<\/span><\/p>\n

A deed of gift provides both the donor and the recipient with proof that the gift has been made. As a donor, you can also make the gift conditional in various ways. If you want your gift to be the recipient’s private property and not to be included in any division of property, you can ensure this in a deed of gift.<\/span><\/p>\n

Advance on inheritance<\/h2>\n

A gift to a direct heir is generally considered to be an advance on his\/her inheritance. This means that the gift is deducted from the future inheritance.<\/span><\/p>\n

If you do not want the gift to be deducted from your inheritance, the donor can stipulate this in the deed of gift. However, it is important to bear in mind that a gift may risk encroaching on the other direct heirs’ share of the inheritance, i.e. the share to which each direct heir is entitled. This may lead the other heirs to contest the gift.<\/span><\/p>\n
