What if I discover a defect in the housing cooperative unit when I move in?<\/h2>\n

The purchase of a housing cooperative unit is governed by the Sale of Goods Act. There is a defect in a housing cooperative unit if the housing cooperative unit does not correspond to what the parties agreed upon or if the housing cooperative unit deviates from what the buyer could reasonably have expected. What a buyer can reasonably expect depends on the circumstances of the individual case. Circumstances of importance include the age, condition and renovations of the housing cooperative unit.<\/p>\n

As a buyer, you are often asked to inspect the housing cooperative unit before you buy it. If you have been asked to inspect the property, you cannot normally invoke defects that you should have discovered during the inspection. In practice, therefore, the buyer has a similar obligation to examine the housing cooperative unit as when buying a property.<\/p>\n

As a buyer, you are also expected to inspect the housing cooperative unit when you take possession of it. Any defects discovered at that time must be reported to the seller within a reasonable timeframe.<\/p>\n
