Instead, it is the contract between the parties that determines what applies between them. To supplement what is not explicitly regulated in the contract, related legislation is used, such as the Sale of Goods Act and customary practice in the industry. It is important that the contract that is drawn up is clear with regard to such matters as what work is to be carried out, how it is to be carried out, at what price and what other conditions are to apply to the construction work.
