When a child, young person or an adult is at risk of serious harm due to, for example, domestic abuse, substance abuse or serious mental illness, the state has an ultimate responsibility and duty to intervene to protect them. In the first instance, this should be done through voluntary action by social services. When voluntary efforts are not possible or do not provide the necessary care for the individual, support can instead be given through compulsory interventions.<\/span><\/p>\n

Care for young individuals \u2013 LVU<\/h2>\n

A child can be taken into care under the Care of Young Persons Act (LVU) if there are deficiencies in the child’s home circumstances or if the child has problems linked to substance abuse or criminality. In most cases, such a decision is made by the court after an investigation has been carried out by the social services. In emergency situations, the social welfare committee may decide to take a child or a young person into immediate care pending a court decision. Such a decision is subsequently reviewed by the court.<\/span><\/p>\n

If the child or young person is taken into care, a public counsellor is appointed to represent the interests of the child or young person and their guardian. The public counsel is paid for by the State. You can request any lawyer you want to represent you.<\/span><\/p>\n

Care for Individuals with Substance Abuse \u2013 LVM<\/h2>\n

Under the Care of Addicts Act (LVM), a person who is detained for abuse of alcohol, drugs or volatile solvents can be helped to recover from the abuse. This may apply if the substance abuse poses a serious risk to mental or physical health or causes harm to the individual struggling with addiction or someone close to them.<\/span><\/p>\n

The person concerned is appointed a public counsel whose task is to look after their interests.<\/span><\/p>\n

Care for psychiatric disorders – LPT<\/h2>\n

Under the Compulsory Psychiatric Care Act (LPT), a person suffering from a serious mental disorder can be detained and cared for against their will. However, the need for care must be necessary and cannot be met voluntarily.<\/span><\/p>\n

Compulsory psychiatric care may mean that the person concerned must take the prescribed medication and cannot leave the medical centre where he or she is being treated. The decision on compulsory psychiatric care is taken by a doctor and it is then the court that decides whether the conditions for care under the LPT are met.<\/span><\/p>\n
