What is a leasehold?

A leasehold is a contract for the use of land whereby the lessee is given the right to use the land in return for payment to the landowner.

There are different types of leaseholds: agricultural, residential, building and apartment leases. The type of lease depends on the use to which the leased land is to be put.

Agricultural, residential and building leases must be concluded by a written contract to be valid.

Disputes are resolved by the Rent and Tenancy Tribunal

The Land Code contains rules relating to leases which are largely aimed at protecting the tenant. Terms in the contract between the landowner and the tenant that contravene such protective rules are not normally binding on the tenant.

In the event of a dispute between the landowner and the tenant, the Rent and Tenancy Tribunal can help mediate between the parties and, like a court, issue rulings if the parties fail to reach an agreement.
