Property division in Gothenburg and Kungsbacka
When you get married, you don’t want to think that your marriage will end. Unfortunately, all marriages end sooner or later, either through divorce or death. This normally leads to a division of property where the spouses’ assets are divided.

How is a division of property carried out?
In a division of property, assets that are not private property are divided equally between the parties after deduction of debts. Property can become private through a prenuptial agreement, a reservation in a deed of gift or a will. Such property should therefore not be included in the division of property. There are also some additional exceptions regarding property that should not be included in the division of property.
In the case of a division of property between cohabitants, the home and household goods acquired for your joint use are shared. However, other property acquired by each of you is not included.
It can often be easier to manage a division of property if you use the services of a competent lawyer. If you cannot reach an agreement, both or either of you can apply to the district court for an estate distribution executor. An estate distribution executor has the power to divide the estate if the parties cannot agree.
When do you divide your property?
A division of property normally takes place upon divorce or death. A division of property may also be carried out during a marriage to equalise property relations.
It may also be required when a cohabitation relationship ends, if requested by either party. In such cases, a division of property must be requested within one year of the end of the cohabitation.
