If parties cannot reach agreement on how to divide their assets during the break-up of a marriage or cohabitation, they can apply to the court to have a settlement adjuster appointed. The settlement adjuster will investigate whether it is possible to come up with a solution in agreement with both parties. If this is not possible, the settlement adjuster makes an executive decision.
The general rule is that the cost of a settlement adjuster is split between the parties. The responsibility to pay is shared, which means that the settlement adjuster can demand payment from either one of the parties. In some circumstances the parties can be compensated for five hours of work by what is known as the ‘payment guarantee for settlement adjusters’.
