Regulation of commercial construction law
When it comes to commercial construction contracts, there is no statutory regulation. Instead, it is the contract between the parties that determines what applies between them. To supplement what is not explicitly regulated in the contract, related legislation is used, such as the Sale of Goods Act and customary practice in the industry. It is important that the contract that is drawn up is clear with regard to such matters as what work is to be carried out, how it is to be carried out, at what price and what other conditions are to apply to the construction work. For this reason, standard form contracts have been developed and are widely used in the construction industry.
Standard form contracts
- AB 04 (AB 25), which are intended to be used for building, civil engineering and installation contracts on a design-build basis, i.e. when the employer carries out the planning and the contractor the execution.
- ABT 06 (ABPU 25), which are intended to be used for building, civil engineering and installation works on a turnkey basis, i.e. when the contractor is responsible for both design and execution.
AB 25 and ABPU 25 are revised versions of AB 04 and ABT 06, respectively, published in 2025 with the aim of modernising the standard form contracts. For more information on the differences between the new and previous standard form contracts, see our article series in the Knowledge Bank.
- AB-U 07/ABT-U 07, which are intended to be used in agreements between the general contractor and subcontractor in cases where the standard form contracts above are used between the employer and the general contractor.
