Why do inheritance disputes arise?

When a loved one dies, many emotions and memories arise, leaving us ill-equipped to divide an inheritance. In the midst of grief and emotional turmoil, it is not always easy to be wise, fair or even rational. This is why conflicts often arise around inheritance. In the event of a death, the parties to the estate, i.e. the heirs and any beneficiaries, may have different views on how the deceased’s property should be distributed, and this may lead to an inheritance dispute.

How to resolve an inheritance dispute?

If the parties to the estate do not agree on a distribution of its assets, the district court can appoint an executor to decide who gets what in the estate. If there is an appointed estate administrator, he or she is usually also the estate distributor.

Hopefully, the inheritance dispute will not go to court but will be resolved beforehand through discussions. The aim is always to reach a solution that everyone can be happy with as easily and quickly as possible. Unfortunately, inheritance disputes are often gruelling and risk damaging relationships at a time of grief.

Formally, parties to an estate may challenge or contest the distribution of inheritance within four weeks of receiving the distribution documents. This involves initiating legal proceedings against the other parties to the estate in the district court, resulting in an inheritance dispute being brought before the court.

It is advisable to hire a lawyer at an early stage to defend your rights or at least avoid a long and drawn-out court process.
