If the partners in an estate cannot agree on how to distribute the assets, one of them can apply to the district court for the appointment of an executor. This person’s main task is to try to get the partners in the estate to reach an agreement. If this is not possible, the estate distributor will instead decide on the distribution of the estate.

What does an estate distributor do?
The District Court may appoint an estate distributor upon application from a party to the estate. The primary role of the estate distributor is to facilitate an amicable resolution among the parties. Should the parties reach an agreement, they can sign a binding agreement of estate distribution.
An estate distributor does not investigate the estate’s assets and liabilities. If such an investigation is required, an application for the appointment of an estate administrator should be made instead.
In addition to the application fee charged by the District Court, the estate distributor is entitled to compensation for their work, which is paid from the estate’s assets.
What does a compulsory distribution entail?
If the parties to the estate cannot reach an agreement, the estate distributor will decide how the inheritance should be divided. This decision is based on any existing will and the applicable laws.
Anyone dissatisfied with the decision has the right to challenge it in the District Court within four weeks of being notified of the decision.
