What is inheritance law?
Inheritance law governs the legal succession of assets following a person’s death, as outlined in the Swedish Inheritance Code (Ärvdabalken). It determines who is entitled to inherit and how the estate is distributed. While a will allows the deceased to specify their wishes, the law also provides a default order of succession for spouses, children, and direct heirs in accordance with the Inheritance Code.

In Sweden, inheritance law protects the relatives of the deceased. The right to a share of the estate depends on the degree of kinship. While it is possible to bequeath assets through a will, children are always entitled to their statutory share of inheritance and a spouse has the right to their marital property.
