Easement disputes
An easement gives a property the right to use another property, for example a road that crosses another property.
An easement can arise through an agreement between the person who is going to use the other person’s property, the ruling property and the person who provides the property, the serving property. Such an easement is called a contract easement. The agreement must be in writing and state the purpose of the assignment. The easement must be useful to the property that is to use it. Entering the contract of the easement in the property register ensures that it is also valid for future owners.
An easement can also arise by decision of court or authority, a so-called official easement. Such easements are only obtained if it is essential for the property that is going to use it.
